In Cased You Missed It.

I want to discuss the importance of something that appeared on this meeting agenda and explain what code of Virginia, section 2.2-3711 (A)(5) means.

Because this discussion took place in a closed session I cannot say exactly what Project Bluejay and Project Nemo are.

My goal is to simply point out when these projects were discussed and explain what this section of the law allows.  That way, members of the public can better understand the process and, if these projects are announced in the future, have the context on decisions affecting the community were made. 

What does Virginia Code 2.2-3711(A)(5) actually mean? 

In plain English, this law lets local governments temporarily meet behind closed doors when they are talking with a company that might bring jobs or invest in the area. The idea is to protect confidential business negotiations while they'they're still in progress.

For example, if a company is considering buying land, negotiating tax incentives, or deciding whether to build a facility in Smyth County, the county can discuss those negotiations privately until the company is ready to make its plans known to the public.

That is why projects are often given code names like Project Bluejay or Project Nemo instead of using the companies real name.

What is doesn't mean:  It does NOT mean officials can male final decisions in secret. Any official votes or actions must still take place in an open meeting. The closed sessions are meant for discussing negotiations public decisions.
